This sort of thing falls mainly on the individual managers/staff uploading this stuff. Can Graal be held accountable? Yes, but this is just staff(aka people like you) having stupid judgement. However, you can bypass copyright by 1) not using trademarks and 2) not infringing on copyrighted designs. A red hat can not be copyrighted. A red hat with a white circle and a big "M" can. Avoid the big "M" and you're good to go.

No it won't.
If Nintendo finds something wrong, they will send a Cease and Desist about whatever is causing problems and from there Unix and co. can choose to fight it, or remedy the problem(remove the troubled graphics). In this case, the tileset would
not be a problem, and they should fight it. However, if some stupid staff uploaded a Pikachu hat, called it a Pikachu hat, then yes, they should remove that.
