Games aren't tied to a console. There just isn't a unified account system yet, so you have to do a system transfer to get your games over to a new system. Which is incredibly easy. I transferred all my OG 3DS data to my 3DS XL in less than an hour. The only problem is that if you lose/break your 3DS before you can transfer the data you're screwed. I guess that is a big problem though.
