I hope you know what you're getting into, if this gets any sort of popularity you'll probably get served a DMCA from Nintendo regardless of if you say all rights remain with Gamefreak and Nintendo . The current online games that are floating about get around this via extracting the copyrighted data from the rom files, which players need to provide themselves, ie they do not distribute any copyrighted media.
