The same goes for other inventions like smartphones, which Apple and Samsung are in a battle over right now. It's really frivolous for companies to sue each other over this stuff nowadays, but they'll do whatever they can to make up for their own shortcomings.

For what it's worth, most lawsuits of this form are not filed to win, but to simply have the opponent (defendant) disclose any and all details in regards to their product, whether it be code, formulations, or what not. This ensures the accusing company the ability to replicate aforementioned product without copying 100%.
