I vaguely remember something about a lawsuit with Nintendo which prevented them from advertising officially.

that was because i think the game was called zelda online and unix was making money of something copyrighted by Nintendo, also nintendo doesn't mind games that are fan made. Look at super smash flash 2, that game is advertised at offical tourneys like Apex2015 that is sponsered by nintendo.
