Thoughts on jailing doctors?
There is this movement going on in Mexico called "Soy 17" or "I am 17" because 16 doctors were sent to jail for the unprofessional or bad treatment of a patient. Who knows what they did wrong, accident or not it left me to think in this ethic situation. What do you think about penalties on doctors? Like, do you think it is fair to jail a doctor if s/he made a mistake or the patient died on his hands even though they tried hard to save it? They spend their lives saving lives, and still get discriminated a lot, or at least in this dumb country. |

Hell no. Medical science is never 100% accurate. Unless they purposely harmed someone, they should have no penalties. I guess negligence would also be a valid reason, but simple mistakes or accidents happen, and they shouldn't go to jail because of them. If they spend their lives trying to save and protect people, and then they're treated like garbage because they make mistakes like everyone else, then that profession would be damaged, and coild even cause less people to go into that field, which could cause even bigger problems. Seems a lot like the same situation the police (in America) are going through. (I don't want to make this about the police, just comparing.)

theres a difference between "unprofessional or bad treatment of a patient" and making a mistake.

Jailed? No. Losing their jobs? Yes. |

It depends what they've actually done like Ik like a year back near me a doctor was meant to give a few patients injections of some kind to help with treatment they was getting yet the doctor injected them with something different, few days later think like 3 died and few were in critical conditions. So for me Yes they should be jailed if something major that results in deaths-or leaving patients in critical conditions.. And if not as major but is something that they should know or whatever then they should still be sacked. They go through a heck load of training and tests etc having to get pretty much everything right to actually get the job, so big mistakes shouldn't really be happening at all(I guess here they could say about shortage of staff and long hours etc but end of the day they knew that before going for job) |

Depends on if it's actual malpractice... which I'm pretty sure at least in the US such cases are heavily evaluated and given a trial.

maybe if the doctor does something so ******ed that it literally can't even be conceived as an accident (i.e. stabbing someone in the face when the doctor was working on the patient's leg) but other than that obviously they should just take their medical license or fire them at the worst, everyone makes mistakes Edit: Okay found a thread from Reddit explaining the whole situation, from like two years ago; praise reddit! I'll paste it in a spoiler for those too lazy to go to the link. Spoiler

These cases are far too individualized to just say "jail doctors" or "do not jail doctors." Besides that, many surgeons(especially heart of brain) may be working 130+ hours a week. They can get called home from vacations to work on a patient. Mistakes are much more likely to happen in environments like that. |

Problem is that people tend to see doctors as servants (many people do) and them making a mistake or having to do something that the patient doesn't likes makes the patients think they are evil and doing it on purpose, which is what I think it sucks. Heard about a friend's mother who was complaining too much and was about to sue the doctors because they had to move her to a wheelchair but moving her legs hurts her. In this case, who wins tbh? Courts give more credit to the patient's complaints than the doctor's words, at least in my crappy law system.
