Botanically the Tomato is a fruit, however, at the United States supreme court, Justice Gray ruled that because tomatoes where known as and used as vegetables, that's what they were...vegetables! I don't believe things are what they are, just because much of the population considers them as it. It is a fruit.

Vegetables can be a lot of different things including fruit (tomatoes), flowers (broccoli) and roots (carrots). The classification of vegetable is culinary, meaning that it only really matters when you talk about cooking. Tomatoes are used in the kitchen in the way that we use other vegetables, so even though it is a fruit by scientific classification, it's also a vegetable by culinary classification.
