I see no issues. Those who don't like it can leave said guild and form their own guild called "Happy Spam Guild" and live the lives they always wanted. Plenty of guilds to join out there, if you join one that doesn't let you chat, either endure that restriction, or leave. Simplicity in it's finest.

" This muting thing isnt new its been around since there were MMOs. im sure many other games based in america has that as well Im not saying that we should follow WOW in everything but that "amendments" and even "law" just isnt part of the reason why we shouldnt have the mute button.
