That's not true really. They can still send a C&D if they feel like it, which usually happens if something gets enough traction to gather a lot of public interest. The whole "you can't get in trouble if you don't profit" thing is a myth and only true in the sense that most of the time 1) it won't get to lawyer ears and 2) they won't care about some small little project a small community is interested in.

If he ever wants this project to be something serious he'll need to address the copyright issues.

If they actually found out about it, like Dusty said, there wouldn't be enough money involved most of the time to actually care. Even if they did care, there still wouldn't be enough money involved to do anything serious. They would probably just send a cease and desist letter if they actually cared enough to do anything about it. They're definitely not going to care about someone making a mario game as a coding project though. I would actually think they like people doing this (like someone said Nintendo does) because it's basically free advertisement.

You're right. I didn't look at the OP, so I didn't see the ripped sprites and stuff until now. I thought it was just a Mario-clone with custom stuff.

Correct. The game is not ever going to be released as a source of income for me as I'm doing this project more for myself to learn more about creating networked programming and the concepts that go along with it. I intend on keeping this project small and not neccessairily marketting it to large communities as it's just a project for my computer science course. However, if this game were to raise popularity I would definitely intend on changing the graphics and the name to reflect an original branding.

That's an absurd accusation! In no way is Graal a rip-off of The Legend of Zelda.
